These Terms & Conditions (hereby referred to as the “Terms”) govern the use of and access to our social media services (hereby referred to as the “Services”). Please read these Terms of Service carefully before using Tiksty.
These Terms are legally binding.
This website is operated by Tiksty Marketing FZCO, Dubai Silicon Oasis, A1 Desk, Dubai, United Arab Emirates. Throughout the site, the terms “we”, “us” and “our” refer to Tiksty.
By visiting our site, creating an account, or purchasing a subscription, you engage in our Service and agree to be bound by these Terms, our Privacy Policy, and any policies referenced herein.
Tiksty is not affiliated with TikTok or any TikTok third-party partners in any way.
We reserve the right to update or change these Terms at any time by posting updates to our website. Continued use of the Service after changes constitutes acceptance of those changes.
Definitions
Customer – any individual, company, organisation or other legal entity using the Service.
Subscription – a recurring paid plan for access to the Service.
Billing Period – the monthly or yearly cycle under which the Customer is charged.
Eligibility
By using our Services, you confirm that:
- You are at least 18 years of age
- You have the legal capacity to enter into a binding agreement
- All information provided to us is accurate and complete
Our Services are not available to persons under the age of 18.
Description of Service
Tiksty provides a social media growth and account management platform designed to increase visibility and engagement by bringing the attention of real users to your TikTok profile.
We do not sell followers.
We do not guarantee specific numerical results.
You understand that you are paying for:
- time
- strategy
- software
- automation
- account management effort
and not for a guaranteed outcome.
Customer Responsibilities
It is the sole responsibility of the Customer to:
- Comply with TikTok’s terms, rules, and all applicable laws
- Maintain access to their account by providing valid login credentials when required
- Ensure their account remains connected to the platform
The Customer uses Tiksty at their own risk.
Tiksty has no control over TikTok and is not responsible for:
- account suspensions
- feature removals
- algorithm changes
- platform-side limitations
To provide the Service we may require your TikTok username and password for secure connection.
Login credentials are:
- encrypted in transit
- not stored after connection
- never shared with third parties
The Customer agrees not to initiate a chargeback or payment dispute without first contacting support to seek a resolution.
Subscription, Billing & Cancellation
All plans are subscription based.
By purchasing a subscription, you authorise us to charge your payment method on a recurring basis for the selected Billing Period.
Subscriptions:
- renew automatically
- remain active until cancelled
Cancellation:
- can be done at any time
- takes effect at the end of the current Billing Period
- does not retroactively stop charges for an already active billing cycle
Access to the Service continues until the end of the paid period.
14-Day Right of Withdrawal (EU & UK Consumers)
If you are a consumer residing in the European Union or the United Kingdom, you have the right to withdraw from your purchase within 14 days, without giving any reason.
If you request immediate activation of the Service, you acknowledge that:
- the Service begins during the withdrawal period
- the refundable amount may be adjusted proportionally to the portion of the Service already delivered
Refunds are processed to the original payment method within 3–10 business days.
This right does not apply to:
- fully completed service periods
- business customers (B2B transactions)
Refund Policy
Monthly subscriptions are generally non-refundable once the billing cycle has started, except where required by law or covered by the 14-day withdrawal right.
Yearly plans are offered at a discounted rate and are non-refundable after the 14-day withdrawal period.
Refund requests based on:
- growth speed
- follower quality
- engagement levels
are reviewed in accordance with this policy and are not guaranteed.
Where service downtime occurs due to technical issues on our side, we extend the billing period rather than issuing monetary refunds.
Paused or disconnected accounts do not pause billing.
Failure to provide valid login credentials does not entitle the Customer to a refund.
Action-Based Guarantees
Where a plan includes an action guarantee, and the guaranteed level of activity is not reached, we will extend the current billing period until the agreed level of service is delivered.
This is done by postponing the next billing date.
Acceptable Use
You may not use the Service:
- for any illegal or unauthorised purpose
- to transmit malicious code
- to resell the Service without written permission
- to reverse engineer or copy the platform
Violation of these Terms may result in immediate suspension or termination of the Service without refund.
Data Protection & GDPR Roles
For the purpose of applicable data protection laws:
- The Customer is the data controller
- Tiksty is the data processor
We process personal data solely for the purpose of providing the Service, in accordance with our Privacy Policy.
Service Availability
We do not guarantee uninterrupted or error-free operation.
Where downtime occurs due to our systems, we will extend the billing period within reasonable limits.
Limitation of Liability
To the maximum extent permitted by law, Tiksty shall not be liable for:
- indirect or consequential damages
- loss of profits
- loss of revenue
- loss of business
- loss of data
- reputational damage
- account suspensions by TikTok
Our total liability for any claim shall not exceed the total amount paid by the Customer to Tiksty in the three (3) months preceding the claim.
Indemnification
The Customer agrees to indemnify and hold Tiksty harmless from any claims, damages, or expenses arising from:
- misuse of the Service
- violation of these Terms
- breach of TikTok’s terms or applicable laws
Termination by Us
We reserve the right to suspend or terminate access to the Service immediately if:
- these Terms are breached
- a chargeback is initiated without prior contact
- fraudulent activity is detected
- payment fails
Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the United Arab Emirates.
Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Dubai.
